Who really owns AI-generated content?
In recent months, artificial intelligence has entered—almost without asking permission—the daily processes of companies, agencies, and professionals. We write texts with AI, generate images for marketing campaigns, develop code, and build interfaces. Everything is faster, cheaper, and more scalable.
But there is a question that remains unresolved, and that is rarely addressed with the necessary level of attention: who actually owns those contents?
The intuitive answer—“they’re mine, I generated them”—is also the most dangerous one.
Copyright law, at least in the European system, still revolves around a very precise concept: protection arises from a human creative act. The result alone is not enough. What matters is the process, and above all, who carries it out.
This means that when content is generated entirely by an artificial intelligence system, without a qualified creative contribution from a human, we may be dealing with something that is not legally protected. Not because it lacks value, but because—under the current structure of the system—it lacks the prerequisite for protection.
And here lies a first short circuit.
Many companies are investing time and resources in content that could, in reality, be freely reused by anyone. Without exclusivity. Without the ability to object. Without, ultimately, real control.
The issue becomes even more complex when we take a closer look at what happens “inside” these processes. AI is often treated as a single black box, but in reality, there are multiple layers. There is the prompt—the human input—which in some cases may have its own independent creative value. There is the output—the generated result—which is what companies are typically interested in. And then there is everything behind it: the datasets, which remain outside the user’s direct control but can have a concrete impact in terms of risk.
And it is precisely here that the issue stops being theoretical.
In practice, we are increasingly seeing companies using AI-generated content in commercially relevant contexts—campaigns, products, platforms—without asking whether that content truly “belongs” to them or whether it might expose them to claims.
The problem, in these cases, is not the use of AI itself. It is the absence of a legal framework accompanying that use.
There is an implicit assumption that everything works as in the traditional world: I create something, I become its owner, I can exploit and protect it. But with AI, this sequence breaks down. And if it is not consciously reconstructed, the risk is operating in a legal grey area.
This is where contracts become central.
Not because they can “create” rights where the legal system does not recognize them, but because they can regulate what happens between the parties: who uses what, under which limits, and with which responsibilities. They can clarify expectations that would otherwise remain implicit—and often divergent.
In practice, this means explicitly addressing the ownership of outputs, avoiding standard clauses that assume full ownership. It means carefully managing representations and warranties, without promising what cannot be fully controlled. And above all, it means allocating risk consciously, because part of that risk—linked to the very functioning of AI models—cannot be eliminated.
The most common mistake today is to think of AI as merely a more efficient tool. In reality, it challenges the very way we connect creation, ownership, and responsibility.
For this reason, the real issue is not whether to use artificial intelligence. That decision has already been made, often without even realizing it.
The issue is how to use it.
And above all, how to build around its use a structure that is coherent not only from a technological standpoint, but also—and perhaps above all—from a legal perspective.
Because in a context where everything can be generated, the real difference is not what you produce.
It is what you are able to protect and control.
