We assist our clients in assessing the lawfulness and compliance of advertising campaigns and communication strategies, ensuring full adherence to the Italian Advertising Self-Regulation Code, the Consumer Code, and all applicable sector-specific regulations, including digital and multi-channel advertising frameworks.

Our clients include advertising agencies, communication companies, television broadcasters, telecommunications operators, designers, copywriters and account managers, whom we support throughout the entire lifecycle of advertising and promotional initiatives, from concept development to market launch.

In particular, the Firm provides legal assistance with respect to:

  • the design and implementation of promotional initiatives and related commercial communications, in compliance with the Consumer Code and applicable industry regulations;

  • the regulation and legal support for prize promotions and contests (including prize draws and competitions), as well as the structuring of Loyalty, Cashback and Bundle programs;

  • the drafting and negotiation of a wide range of commercial partnerships (e.g. co-marketing agreements) and service contracts, including media planning, call center services, creative agencies and digital marketing services;

  • assistance in proceedings and investigations before the Italian Competition Authority (AGCM), particularly in matters relating to unfair commercial practices and misleading advertising;

  • monitoring and assessment of competitors’ conduct, including actions aimed at reporting unlawful practices to the relevant authorities or self-regulatory bodies.

Selected Experience in Advertising and Consumer Law

In this area, the Firm has, among others:

  • provided ongoing legal assistance to a leading company belonging to an international group, operating in Italy in the pay-TV and telecommunications sectors;

  • advised a major French advertising agency on issues relating to the confusability and legal compliance of an advertising pay-off;

  • represented advertising agencies and companies in advertising disputes and in proceedings before the Advertising Self-Regulatory Jury.
